教師法在教學不適任教師處理之問題與改革策略 [詳全文]

摘要:

民國108 年6 月5 日修正通過的《教師法》,對於「不適任教師」的規範有了大幅的變動,我國不適任教師的處理將走入一個新紀元。為了改善中小學教學不適任教師處理,本文藉由文獻探討與文件分析法,先對國內中小學不適任教師處理的現行教師法及其相關子法,加以評論,然後對其機制上的缺失,提出一些改革建議。本文發現,新制的教學不適任教師處理具有:新設立的校園事件處理會議,可加速教學不適任教師的處理;將教育專業審查會提至法律位階,使案件處理更為客觀公正等九個特色。唯新制的教學不適任教師處理亦有忽略了不適任教師的預防、教學不適任的認定標準過於嚴苛並與教師專業標準脫勾、校園事件處理會議有流於濫訴與干擾教學之虞、教育專業審查會的任務有過於強調評審疏於輔導之虞、調查員與輔導員的培訓與補償有待加強等九個問題。針對上述問題,本文提出建立完整教師評鑑體系、早日完成教師評鑑之立法、早日完成初任教師導入輔導之立法、善用教師專業標準與教師評鑑規準、慎用校園事件處理會議的機制、擴增教育專業審查會職權、強化同儕協助的機制與功能、加強調查員的培訓與補償工作、加強輔導員的遴選、培訓與補償工作等十三個建議。

Problems and Reform Strategies of the Teacher Law in Managing
Teaching Incompetent Teachers

The "Teacher Law" amended and passed on June 5, 2019, hasdramatically changed the norms of "incompetent teachers,” and the management of incompetent teachers in our country will enter a new era. To improve the management of unqualified teachers in primary and secondary schools, this article first reviewed the current teacher law and its related sub-laws on the treatment of unqualified teachers in primary and secondary schools in Taiwan. Then it discussed the lack of mechanisms and proposes some reform proposals. This article discovered that the new system of managing incompetent teachers has the following advantages:the newly established campus incident handling conference speeded up the management of unqualified teachers; the education professional review committee had been raised to the legal level, and an objective, professional, and neutral third party assisted schools in handling cases of teaching incompetence to make the case handling fairer, etc. However, the new system of management of teaching incompetent teachers also ignored the prevention of unqualified teachers; the identification standards of teaching incompetence were too strict and out of touch with the professional standards of teachers; the campus incident handling meeting had the risk of excessive complaints and interference with teaching; the tasks of the professional review committee over-emphasized on the peer review while overlooking peer assistance; training and compensation for investigators and mentors should be enhanced, etc. Given the above problems, this paper proposed to establish a complete teacher evaluation system, to complete the legislation of teacher evaluation as soon as possible, to complete the legislation of beginning teacher induction as quickly as possible, to make good use of teacher professional standards and teacher
evaluation standards, to use the mechanism of campus event handling conferences cautiously, to expand the authority of the education professional review committee, to strengthen the mechanism and function
of peer assistance, to strengthen the training and compensation of investigators, to strengthen the selection, training, and compensation of mentors, etc.
